Terms

§1 Definitions

1. Organizer – Fundacja Karola Śliwki (Karol Śliwka Foundation) with its registered office in Gdańsk, Poland, at ul. Okopowa 17/11, NIP: 5482730230, REGON: 385920216.

2. Ilustrator Festival – Festival of Illustrated Communication – an Event organized by the Organizer for educational purposes, in which only persons who have purchased a Ticket may participate.

3. Website – the event's website located at https://www.ilustratorfestiwal.pl.

4. Ticket – an electronic document confirming the conclusion of an agreement enabling participation in the event, with its name, date, and venue indicated on the ticket.

5. Buyer – a person who is a party to the agreement and who has purchased a Ticket or Tickets for the Event through the system on the Website.

6. Ticket Recipient – a person to whom the Buyer transfers a Ticket.

7. Voucher – an electronic code that can be exchanged for a Ticket.

8. Participant – a person holding a valid Ticket for the Event.

§2 Provision of electronic services

1. The Organizer provides electronic services via the Website in accordance with the Polish Act of 18 July 2002 on the Provision of Electronic Services.

2. These services include in particular:

   1. the ability to register a user account,

   2. the ability to purchase a Ticket for the Event,

   3. access to the user panel to manage purchased Tickets,

   4. automatic issuing and sharing of VAT invoices,

   5. sending system messages related to order processing.

3. The agreement for the provision of electronic services is concluded upon successful registration of an account on the Website and remains valid until it is terminated by the User or the order is fulfilled.

4. The User may terminate the agreement for the provision of electronic services at any time by deleting their account or by sending a request to: info@ilustratorfestiwal.pl.

5. The Organizer reserves the right to cease providing electronic services after prior notification to the users.

6. Complaints related to the provision of electronic services may be submitted in accordance with the procedure described in §5.

§3 Ticket purchase

1. Tickets for the Event may only be purchased via the online system available on the Website.

2. Tickets are sold in three batches:

   1. Early Batch – the first batch of tickets available in limited numbers until sold out,

   2. Regular Batch – the second batch of tickets available after the Early Batch sale ends, until sold out,

   3. Late Batch – the third batch of tickets available after the Regular Batch sale ends, until sold out.

3. Purchasing tickets from any batch entitles the holder to participate in the Event in the same form. Only one batch is available for sale at any given time – it is not possible to select tickets from another batch during the purchase process.

4. To purchase a ticket, the following steps must be completed:

   1. select the quantity and type of ticket,

   2. log in or register on the Website,

   3. review the order summary and, if applicable, provide invoice details,

   4. make payment.

5. The ticket purchase agreement is concluded at the moment the payment is confirmed by the payment operator.

6. Tickets cannot be exchanged for another date or type of ticket, except in cases expressly stated in these Terms.

7. When creating an account, the Buyer must provide their first name, last name, email address, and password, and accept these Terms and Conditions.

8. The order form must contain accurate and truthful personal data of the Buyer.

9. When purchasing a ticket for another person, the Buyer undertakes to inform other Participants of the contents of these Terms and Conditions.
   10. Purchased Tickets will be sent to the Buyer by email and made available for download in the user panel.
   11. Invoices for companies are issued automatically after providing complete company details during the order process.
   12. Payment transactions are processed via Stripe, Inc., headquartered at 354 Oyster Point Boulevard, South San Francisco, CA 94080, USA.

§4 Refunds, complaints, and event cancellation

1. In accordance with Article 38(12) of the Polish Consumer Rights Act of 30 May 2014, the Buyer is not entitled to withdraw from a distance contract for services related to cultural, entertainment, or sporting events that take place on a specific date or during a specific period. Therefore, as a rule, Tickets are non-refundable.

2. The exception is when the Event is cancelled by the Organizer. In such a case, the Organizer will refund the full amount paid for the Ticket(s) and issue the appropriate corrective invoice. Refunds will be made within 14 days from the date of notification of the Event’s cancellation.

3. The Organizer reserves the right to change the Event programme for important organizational, technical, or artistic reasons. Such changes do not constitute grounds for a refund.

4. The Buyer has the right to submit a complaint regarding services provided by the Organizer as part of the Event or electronically. Complaints should be sent:

   1. by email to: info@ilustratorfestiwal.pl, or

   2. in writing to the address indicated in §1 point 1 (Poland).

5. Complaints should include: the Buyer’s first name, last name, contact telephone number, correspondence address, order number, and a description of the service being complained about.

6. The Organizer will review the complaint within 14 days of receipt.

§5 Vouchers

1. A Voucher entitles its holder to exchange it for a Ticket.

2. One Voucher equals one Ticket.

3. A Voucher is not a Ticket and does not allow participation in the Event before being exchanged.

4. Exchanges can be made on the Organizer’s Website.

5. Vouchers are non-refundable and non-transferable.

6. Vouchers are valid for 12 months from the date of purchase, unless otherwise stated. After the expiry date, they lose their value.

§6 Participation in the Event

1. A valid Ticket is required to participate in the Event.

2. Persons under 18 may attend only with the consent and under the supervision of a legal guardian.

3. Bringing alcohol, intoxicants, or dangerous items to the Event is prohibited.

4. The Organizer reserves the right to refuse entry or remove from the Event any person violating these rules.

5. Participant registration is based on the name appearing on the Ticket.

6. The Event also includes accompanying activities such as workshops, for which a separate ticket is required. Tickets for workshops will be available on the Event Website after the announcement of each specific workshop. The number of tickets for each workshop is limited.

7. To participate in Workshops and Consultations, prior registration is required. The registration process will be announced on the Organizer’s Website.

§7 Photo and video recording

1. Participation in the Event constitutes consent to the free-of-charge recording and use of the Participant’s image by the Organizer.

2. Image recording applies to public spaces during the Event for documentation, archival, and promotional purposes.

3. A Participant may object to the recording or publication of their image by notifying the Organizer no later than 3 days before the Event.

§8 Personal data

1. The Organizer, as the Data Controller, processes personal data to fulfil the agreement.

2. The data collected includes, among others: first name, last name, email address, phone number, tax identification number (NIP), and address details.

3. Data is processed in accordance with GDPR.

4. Participants have the right to access, edit, and delete their data.

§9 Final provisions

1. In matters not regulated by these Terms, the provisions of Polish law apply.

2. Disputes will be resolved by the court with jurisdiction over the Organizer’s registered office in Poland.
