Terms and Conditions

§1 Definitions

1. Organizer – Karol Śliwka Foundation with its registered office in Gdańsk at ul. Okopowa 17/11, NIP: 5482730230, REGON: 385920216.

2. Ilustrator Festival – Festival of Illustrated Communication – An educational event organized by the Organizer, in which people who have purchased a Ticket may participate.

3. Website – the event website located at https://www.ilustratorfestiwal.pl.

4. Ticket – an electronic document confirming the conclusion of an agreement enabling participation in the event, the name, date, and place of which are indicated on the ticket.

5. Buyer – a person who is a party to the concluded agreement, who purchased a Ticket or Tickets for the Event using the system on the Website.

6. Ticket Recipient – the person to whom the Buyer transfers the Ticket.

7. Voucher – an electronic code that can be exchanged for a Ticket.

8. Participant – a person in possession of a Ticket for the Event.

§2 Provision of electronic services

1. The Organizer provides electronic services through the Website within the meaning of the Act of 18 July 2002 on the provision of electronic services.

2. These services include in particular:

   1. the possibility of registering a user account,

   2. the possibility of purchasing a Ticket for the Event,

   3. access to the user panel, enabling the management of purchased Tickets,

   4. automatic issuance and provision of VAT invoices,

   5. sending system information related to order processing.

3. The agreement for the provision of electronic services is concluded upon successful registration of an account on the Website and remains in force until its termination by the User or execution of the order.

4. The User may terminate the agreement for the provision of electronic services at any time by deleting the account or sending a request to the email address: info@ilustratorfestiwal.pl.

5. The Organizer reserves the right to cease providing electronic services after prior notification to the users.

6. Complaints related to the provision of electronic services may be submitted in accordance with the procedure described in §5.

§3 Ticket Purchase

1. Purchasing a ticket for the Event is only possible using the IT system located on the Website.

2. Tickets for the event are sold in three pools:

   1. Early Pool – the first pool, in which tickets are available in a limited number – while stocks last,

   2. Regular Pool – the second pool of tickets, available from the end of the sale of Early tickets until stocks last,

   3. Late Pool – the third pool of tickets, available from the end of the sale of Regular tickets until stocks last.

3. The purchase of tickets from each of the pools entitles to participate in the event in the same form. Only tickets from one pool are available at the same time – there is no option to choose tickets from a different pool during the purchase process.

4. In order to purchase a ticket, it is necessary to go through the following purchase steps:

   1. selection of quantity and type of ticket,

   2. logging in or registering on the Website,

   3. order summary and optionally providing invoice data,

   4. payment.

5. The Ticket sales contract is concluded upon confirmation of payment by the payment operator.

6. The Ticket is not subject to exchange for another date or another type of ticket, except for situations explicitly indicated in these Regulations.

7. When creating an account, you must provide: first name, last name, email address, and password, and accept these regulations.

8. The order form must contain the current and true personal data of the Buyer.

9. In the case of purchasing a ticket for someone else, the Buyer undertakes to inform the other Participants of the content of the Event Regulations.

10. The purchased Ticket will be sent to the Buyer by email and made available for download in the user panel.

11. Invoices for companies are issued automatically after providing complete details in the order.

12. Transaction settlements are conducted via Stripe, Inc.

§4 Returns, complaints, and cancellation of the Event

1. According to Art. 38 point 12 of the Act of 30 May 2014 on consumer rights, the Buyer does not have the right to withdraw from a distance contract in the case of services related to cultural, entertainment, or sports events taking place on a specified day or period. As a rule, Ticket returns are not possible.

2. An exception is the cancellation of the Event by the Organizer. In this case, the Organizer will refund the full amount paid for the Ticket or Tickets and issue a corresponding correction invoice. The refund will be made within 14 days from the date of notification of the cancellation.

3. The Organizer reserves the right to change the program of the Event for important organizational, technical, or artistic reasons. The change of program does not constitute grounds for a Ticket refund.

4. The Buyer has the right to submit a complaint regarding the services provided by the Organizer as part of the Event or electronically. The complaint should be sent:

   1. to the email address: info@ilustratorfestiwal.pl, or

   2. in writing to the address provided in §1 point 1.

5. The complaint should contain: first and last name, contact telephone number, correspondence address, order number, and a description of the complained service.

6. The Organizer will consider the complaint within 14 days of its receipt.

§5 Participation in the Event

1. To participate in the Event, it is required to possess and present a valid Ticket.

2. Persons under 18 years of age may participate only with the consent and under the supervision of a legal guardian.

3. Bringing alcohol, intoxicating substances, and dangerous items is prohibited during the Event.

4. The Organizer reserves the right to refuse entry or remove a person violating the rules from the Event premises.

5. Registration of participants is based on the name appearing on the Ticket.

6. During the Event, accompanying events are also organized, including workshops for which a separate ticket is required, which can be purchased on the Event's website after the specific workshop is announced.

   1. The number of tickets for each workshop is limited.

   2. To participate in Workshops and Consultations, prior registration is required.

   3. The form of registration will be announced on the Organizer's website.

§6 Video and photo registration of the Event

1. Participation in the Event means consent to the free recording and use of the image by the Organizer.

2. The recording applies to the image in public space during the Event, for documentation, archival, and promotional purposes.

3. A Participant may object to the publication of their image at least 3 days before the Event.

§7 Personal data

1. The Organizer, being the Data Controller, processes personal data in order to perform the contract.

2. The scope of data includes, among others, first name, last name, email address, telephone number, NIP (tax identification number), address details.

3. Data are processed in accordance with GDPR.

4. The Participant has the right to view, edit, and delete their data.

§8 Final provisions

1. In matters not regulated, the provisions of Polish law shall apply.

2. Disputes shall be resolved by the court competent for the seat of the Organizer.
